A. The following Terms and Conditions contain assumptions of risk and/or liability by Customers and limit and exclude liabilities, obligations, and legal responsibilities which Mobile Telephone Networks Proprietary Limited (“MTN”) will have towards Customers and other persons.
B. These Terms and Conditions also limit and exclude Customers rights and remedies against MTN and place various risks, liabilities, obligations, and legal responsibilities on the Customer.
C. These Terms and Conditions may result in Customers being responsible for paying additional costs and amounts and MTN may also have claims and other rights against the Customer.
D. To the extent that the Terms and Conditions or any goods or services provided under the Terms and Conditions are governed by the Consumer Protection Act, 2008 (“the CPA”), no provision of these Terms and Conditions is intended to contravene the applicable provisions of the CPA. Therefore, all provisions of the Terms and Conditions must be treated as being qualified, to the extent necessary, to ensure that the applicable provisions of the CPA are complied with.
E. The Customer must read these Terms and Conditions. Your participation will constitute as an agreement to comply with these Terms and Conditions.
F. Please pay special attention to all the clauses. These Terms and Conditions are subject to and must be read together with your Subscriber Contract Terms and Conditions, Post-paid Price Plan Terms and Conditions, Prepaid Price Plan Terms and Conditions; and Product/Service Terms and Conditions
MTN is giving away R50 000 in Takealot vouchers to the value of 2 x R10 000 Takealot vouchers; 10 x R3 000 Takealot vouchers. (the “Competition”).
2.1 The Competition commences on September 22, 2023 will continue until December 31, 2023 (“the Competition period").
2.2 The campaign periods are structure as follows:
2.2.1 22 September 2023 – 31 October 2023
2.2.2 01 November 2023 – 30 November 2023
2.2.3 01 December 2023 – 31 December 2023
2.3 The monthly draws will be run:
2.3.1 Between the 6th and 10th November 2023 (for participation from 22 September to 31 October 2023)
2.3.2 Between the 6th and 14th December 2023 (for participation from 1 to 30 November 2023)
2.3.3 Between the 8th and 19th January 2024 (for participation from 1 to 31 December 2023)
2.4 Winners will be contacted telephonically or via SMS shortly after each draw.
2.5 MTN may, in their sole and absolute discretion, amend or withdraw the competition without notice to entrants.
3.1 To be eligible to enter, the entrant must be an MTN customer, using the MTN App, and logging in to the MTN App at least once a week during the competition period.
3.2 Participation in this Competition excludes employees, directors, members, partners, consultants, and agents of, or any other person who, directly or indirectly controls or is controlled by the Promoter or marketing service providers of this Competition, (and the spouses, life partners, immediate family members or business partners of the people or entities listed above.
4.1 During the Competition period, the entrant must log in to the MTN App weekly during the competition periods defined in 2.2. The entrant must also ensure to have at least one login in two different weeks over the respective defined competition periods.
4.2 Assuming the customer has met the minimum login criteria as per clause 4.1, then they will get 1 entry for each day that they have logged in to the MTN App (for the competition periods defined in clause 2.2 above).
4.3 MTN confirms that they will ensure that an auditor conducts and verifies the draw(s)
5.1 Entrants that fulfil the requirements stated in clause 3 and 4 above, stand a chance to win the following:
5.1.1 There will be 12 winners selected, as per the defined campaign period in clause 2.2, who will win a share of the R50 000 in Takealot vouchers.
5.1.2 The breakdown of the prize pool per campaign period defined in clause 2.2 is: 2 x R10 000 Takealot vouchers and 10 x R3 000 Takealot vouchers. No other prizes make up the prize pool (hereinafter referred to as the “Prizes” or “Prize” as the context may require).
6.1 If the winner is unable to redeem the Prize for any reason, or is disqualified for any reason, the winner will then forfeit the Prize and the next placed name will be the winner.
6.2 No portion of the Prizes are transferable, and prizes are not exchangeable for another Prize.
6.3 The selection process to determine the winners and results of the process are final and no correspondence will be entered into.
6.4 The prizes will be sent to the winner on the cellphone number used to enter the competition once MTN has verified that they are the winner and have been in contact with them.
6.5 Winners shall be contacted via the medium used to enter the Competition or in terms of any contact details supplied by the winner when entering the Competition. MTN shall attempt to contact the winner at least three times at the end of each month’s promo. The Takealot vouchers will be shared with the winners digitally via email or SMS. If the winner is not contactable, or that the winner rejects, forfeits or declines acceptance of the Prize, the Prize shall be awarded to the next selected/drawn name.
6.6 Winners will be contacted via telephone, and/or digitally via SMS/email
6.7 The Promoter, its respective directors, affiliates, members, partners, employees, agents, consultants, suppliers, contractors, subsidiaries and sponsors assume no liability whatsoever for any direct or indirect loss or damage, including but not limited to physical harm or death, howsoever arising from or as a result of an entrant’s participation in the Competition or the entrant’s redemption of any Prize in terms of this Competition, or from any amendments to Prize details and/or the terms and conditions of this Competition. All entrants (including the winners) hereby expressly indemnify the Promoter in this regard and shall hold it harmless from all and any claims.
6.8 The Promoter reserves the right to vary the nature of the Competition, the Prize, or these terms and conditions upon notice in this regard being published on www.mtn.co.za or in another appropriate medium. If the Prize is limited or varied in this manner, the Promoter shall replace the Prize with a prize of a similar economic value.

6.10 The decision of the Promoter in respect of disputes arising out of this Competition shall be dealt with by the Promoter in terms of these terms and conditions. The decision of the Promoter in this regard shall be final.
6.11 Entrants are only entitled to win 1 (one) Prize per month.
6.12 MTN reserves the right to withhold the Prize until it is entirely satisfied that the claimant of the Prize is the bona fide winner and reserves the right to call for such proof as it may deem necessary, including proof of identity.
6.13 MTN shall request that winners consent to their name, image and likeness being used and published by the Promoter in connection with this Competition for a period of 12 (twelve) months after they are announced as winners. Winners may decline the use of their name, likeness, and image by the Promoter.
6.14 Where and when applicable, the winner shall be liable to pay any applicable tax related to the Prizes in clause 5 above.
6.15 By entering this Competition entrants signify their consent to be bound by the terms and conditions contained herein.
6.16 By entering the Competition all entrants give their consent to receive various marketing and promotional material from the Promoter. Entrants will be provided with an opportunity to “opt Out” of receiving such communications, which may be via the relevant medium that such marketing communication was received.
6.17 Winners agree that it is an express condition of the Competition that to be eligible to redeem the Prize, the winner shall be required to sign the appropriate acknowledgement of receipt of the prize, as well as an indemnity and/or waiver of liability as reflected in these terms.
