The following Terms and Conditions contain assumptions of risk and/or liability by Customers and limit and exclude liabilities, obligations, and legal responsibilities which Mobile Telephone Networks Proprietary Limited (“MTN”) will have towards Customers and other persons.
These Terms and Conditions also limit and exclude Customers rights and remedies against MTN and place various risks, liabilities, obligations, and legal responsibilities on the Customer.
These Terms and Conditions may result in Customers being responsible for paying additional costs and amounts and MTN may also have claims and other rights against the Customer.
To the extent that the Terms and Conditions or any goods or services provided under the Terms and Conditions are governed by the Consumer Protection Act, 2008 (“the CPA”), no provision of these Terms and Conditions is intended to contravene the applicable provisions of the CPA. Therefore, all provisions of the Terms and Conditions must be treated as being qualified, to the extent necessary, to ensure that the applicable provisions of the CPA are complied with.
The Customer must read these Terms and Conditions. Your participation will constitute as an agreement to comply with these Terms and Conditions.
Please pay special attention to all the clauses. These Terms and Conditions are subject to and must be read together with your Subscriber Contract Terms and Conditions, Post-paid Price Plan Terms and Conditions, Prepaid Price Plan Terms and Conditions; and Product/Service Terms and Conditions
1.1 MTN offers eligible first-time users of the new MTN App a free 1GB data bundle, valid for 24 hours, upon their first successful login to the new MTN App (“the Promotion”).
1.2 Eligible users, as defined in clause 3 will receive 1GB free data, valid for 1 day (24hrs), when they log in to the new MTN App for the first time during the Promotion Period.
1.3 Upon the first login to the new MTN App by an eligible user, the user will be notified in the App that the free 1GB data bundle is available for redemption from the My Gifts menu on the App.
1.4 The free 1GB data bundle must be claimed within twenty-four (24) hours from the time the customer is notified in accordance with clause 1.3. If the bundle is not claimed within this period, it will expire.
1.5 Once redeemed, the 1GB promotional data has a validity of 24 Hours from the time of redemption, after which it will automatically expire.
2.1 The Promotion will run from 8 April 2025 until 31 December 2026 (the “Promotion Period").
2.2 Notwithstanding the Promotion Period, MTN reserves the right, at its sole and absolute discretion, to amend, suspend, extend, shorten or withdraw the Promotion in its entirety, without notice to Customers. Visit www.mtn.co.za regularly for Promotion rules, notices, updates and/or changes to services.
3.1 The Promotion is available to MTN customers who download and successfully log in to the new MTN App for the first time during the Promotion Period, subject to the eligibility criteria and exclusions set out in this clause 3.
3.2 For purposes of this Promotion, a “first successful login” means the first authenticated login to the new MTN App by a customer, as determined by MTN’s internal systems and records. Eligibility may be assessed with reference to the customer’s mobile number, device, or a combination of both.
3.3 Eligibility for the Promotion during the Promotion Period will be assessed at the time the customer logs in to the new MTN App, based on MTN’s internal systems and records as at that date.
3.4 Customers who purchase an eligible device with the new MTN App pre-installed qualify for the Promotion, subject to compliance with the eligibility criteria and exclusions set out in this clause 3.
3.5 The device being used to download the App must be 3G, LTE or 5G enabled.
3.6 Exclusions for the Promotion Period of 8 April 2025 – 31 July 2025:
3.6.1 For purposes of this clause 3.6, “any version of the MTN App” includes all legacy, prior, earlier, and current versions of the MTN App, including the new MTN App.
3.6.2 Customers will not be eligible for the Promotion during this period if the customer’s mobile number has ever previously accessed any version of the MTN App; or
3.6.3 The device used has ever previously been used to download and log in to any version of the MTN App.
3.7 Exclusions for the Promotion Period of 1 August 2025 – 31 December 2025:
Customers will not be eligible for the Promotion during this period if:
3.7.1 The mobile number has ever previously accessed the new MTN App; or
3.7.2 The device has ever previously been used to download and log in to the new MTN App.
4.1 Subscribers who fulfill the requirements stated in clause 3 above will receive 1GB free data, valid for 24 Hours (herein referred to as the “Promotional Value”)
5.1 We respect your privacy, and you voluntarily agree to abide by our privacy policy, which can be viewed at www.mtn.co.za.
6.1 MTN, its respective directors, affiliates, members, partners, employees, agents, consultants, suppliers, contractors, subsidiaries and sponsors assume no liability whatsoever for any direct or indirect loss or damage, including but not limited to physical harm or death, howsoever arising from or as a result of an entrant’s participation in the Promotion or the entrant’s redemption of any promotional value in terms of this Promotion, or from any amendments to Promotion details and/or the terms and conditions of this Promotion. All subscribers/MTN Customers hereby expressly indemnify MTN in this regard and shall hold it harmless from all and any claims arising from or as a result of the above reasons.
6.2 In so far as it is necessary, required by law or beyond the reasonable control of MTN, MTN reserves the right to vary the nature of the Promotion, or these terms and conditions upon notice in this regard being published on www.mtn.co.za or in another appropriate medium.
6.3 With regard to clause 6.2 above, any amended terms and conditions published in any media, or on the MTN website www.mtn.co.za will form part of the terms and conditions of the Promotion, to which terms the entrants agree to be bound.
6.4 The Promotional value is not transferable and is not exchangeable for another prize or cash.
6.5 The decision of MTN in respect of disputes arising out of this Promotion shall be dealt with by MTN in terms of these terms and conditions. The decision of MTN in this regard shall be final.
6.6 By entering this Promotion entrants signify their consent to be bound by the terms and conditions contained herein.
